HR Anew, Incorporated (“we”, “us” or “HR Anew”) delivering the worksmartanew is committed to preserving the privacy of all visitors to (Service). Please read the following privacy policy to understand how we use and protect the information that you provide to us. Privacy and Security

The worksmartanew provides maximum protection for your files and communication. We take the security of your data seriously at worksmartanew. Your data will be protected to the highest possible level with bank-grade security, encrypted backups and additional security measures such as two-factor authentication, complex passwords and controlled user-based permissions.

Data Centers

With worksmartanew, your data will be hosted in a private cloud.  Using a private cloud is equivalent to having the worksmartanew installed on-premises.

Data Hosting Tiers

Our data center has a tier ranking of 1, 2, 3 or 4. The 1 to 4 tier ranking system is a standardized methodology used to define the guaranteed uptime of a data center. The worksmartanew data center is Tier3+. This means that our data center offers a minimum of 98% availability.

For data transfers and storage, worksmartanew uses end-to-end encryption, with 256-bit SSL in transit and AES encryption at rest — the same level of encryption you find with banks. The worksmartanew also supports TLS 1.2 for all communication.

Permissions and Authentication

We go beyond offering bank-grade encryption for worksmartanew customers. There are additional security measures that you can take in order to enhance your data protection and comply with industry standards.

  • Two-factor authentication – Users require something they know (i.e., password) and something they have (i.e., smartphone) in order to access their account.
  • Complex passwords – When your users are setting up their account, you can opt to have them use a combination of letters, numbers and special characters for their password.
  • User-based permissions – Each user has set permissions, defined by the account administrator, enabling the relevant viewing or editor rights.
  • Audit trail – Account administrators can organize and track user activity and generate CSV reports. User activity includes who has viewed, downloaded, created, updated, deleted and logged in to their account.
  • Automatic account lockout – When a user tries to log in to their account and has been unsuccessful after six (6) password attempts, his/her account will be locked for one (1) hour.


worksmartanew uses Amazon Web Services (AWS) for hosting its data center for private cloud solutions, which are ISO 27001, SAS70, PCI certified, HIPAA compliant and comply with US federal government customer requirements by being FISMA and FIPs certified.

HIPAA Compliant

The worksmartanew implements the following security processes and protocols that make it part of a HIPAA compliant solution: encryption for documents in transit and at rest, complete audit trails, automatic log off, controlled logins and granular access to files and folders.

  • Audit trail – Account administrators can organize and track user activity and generate CSV reports. User activity includes who has viewed, downloaded, created, updated, deleted and logged in to their account.
  • Automatic log-off – Users are automatically logged out each time they leave your portal, or they can be automatically logged out of their account every 30 days.
  • Controlled logins – Implement authenticated logins and Administrators can view the audit trail to see when users have logged in.

Changes to Our Privacy Policy

Any changes to our privacy policy in the future will be posted to the Website and, where appropriate, through e-mail notification. Please ensure that you are kept up-to-date with any such changes. By using the Service or accessing the Website you agreed to be bound by the most up-to-date version of this Policy.


Information We Collect from You

If you decide to register with and use the worksmartanew, you will be asked to provide certain information about yourself including your name, email address other profile information you provide; as well as aggregate information about your use of the features of the Services we provide to you, such as the number of files you have uploaded, notes and discussions authored, comments made, and events and tasks made. We protect your personal information.

We may also collect information about your usage of the worksmartanew portal to include (but not limited to) details of your visits to the site, e.g., traffic data, location data and IP addresses; and the Service, as well as information about you, from emails, phone calls or letters that you send to us or from information that you complete from surveys or post on our website. We will only use any such information in accordance with the terms of this privacy policy.

If you are 13 years old or younger you may not register with us on the Website. If we become aware that you are 13 years old or younger and you have not obtained such permission, we will remove your personal information from our records. By entering your details on the website, you are stating that you are 14 years old or older.

App’s use of information received, and App’s transfer of information to any other app, from Google APls will adhere to Google’s Limited Use Requirements.


Use of Your Information

We will only use your information for the following purposes:

  1. To enable us to provide you with access to all parts of the worksmartanew to use the Service and to enable you to download information and materials;
  2. To produce reports, statistics and analysis of the types of people who access the worksmartanew;

  5. To administer, support, improve and develop the worksmartanew;
  6. To carry out our obligations arising from any contracts entered into between you and us.

An opt-out link will not apply where worksmartanew sends you a notice regarding the status of service, upgrades to the platform, security alerts or any notice relevant to your service and account.

HR Anew, Incorporated may use trusted third parties to assist in the delivery, provision, analysis, and improvement of the worksmartanew to include and is not limited to data storage, maintenance services, database management, analytics, payment processing, Customer Relationship Management services/systems and improvement to the Service features. HR Anew is not liable for the quality or accuracy of any onward transfer of information.

We may also disclose your company information to our assigned staff within HR Anew for the purposes set out in this privacy policy.

We reserve the right to use the name and/or logo of the company you work for in publicity material, advertising or marketing collateral unless you specifically tell us otherwise. Your name, address details and all other personal information will remain confidential at all times.


Disclosure of Your Information

We follow strict guidelines in the storage and disclosure of information which you have given us, to prevent unauthorized access. We comply with the laws of the countries from which we operate.

We do not seek any sensitive personal data other than that which is reasonable and necessary for the purposes sought. You are giving your explicit consent to collect, process, disclose, transfer or store your Sensitive Personal Data for the purposes of processing orders for goods and services

You agree to keep confidential and not to disclose to any other individual or individuals for all time the username and password related to your worksmartanew account. Note that although you set the password, it is our proprietary information and belongs to us for all time.

We are not responsible for the privacy policies or practices of third-party websites you may integrate within your worksmartanew portal.


Marketing Information and Opting Out

Accessing, Editing or Removing Your Personal Information

You understand that by accepting an invitation into worksmartanew, those who are in the groups within your company will be able to identify you by your worksmartanew profile. You may view, change, or remove your profile information displayed at any time by going to your profile and editing your information in your Account Settings.

If you want to stop using your account, you may deactivate it. When you deactivate an account, you will not be able to use our Website or Service, and your information will not be capable of being viewed through our portal. After you deactivate your account, copies of your information including (but not limited to) name and email address may be retained by us as backup copies for legal and compliance reasons, unless you state otherwise.



Cookies are small amounts of information which we store on your computer. We issue cookies to your computer when you log on to the portal and when you register with the Service. Cookies are necessary for the operation of the Service and therefore, if you set up your computer to reject cookies you will be unable to access the Service.


Security and Data Retention

We employ bank-grade security to protect your information from access by unauthorized persons and against unlawful processing, accidental loss, destruction and damage. Your information is stored on a private protected server and the transmission of your data is encrypted. However, you acknowledge that we cannot guarantee the security of data that is sent over the Internet. You are responsible for the safe storage of Your access credentials to our Services.

We will process and retain Your information for as long as required and will remove it when no longer needed or upon Your request. We aim to ensure Your information is accurate, adequate, limited to what is necessary concerning the purpose for which it was gathered, kept up to date, and erased or rectified without delay.

Additional Features

You can log in to our platform using single-sign-on (SSO) services such as Google and LinkedIn. These services will allow the third party to authenticate your identity and provide you the option to share certain personal information with us such as your name and email address to pre-populate our signup form.

Some of the functionality of the Services and the worksmartanew interoperate with and are interdependent on application programming interfaces (APls) from third parties, such as Google and LinkedIn. We may collect Personal information from these third-party APls, and our collection, use, and disclosure of that Personal Information will be governed by this privacy policy.

You have the ability to control what Personal Information you share with third parties through our API, but please note that any Personal Information you share with third parties through our API will be governed by their privacy policies and we do not assume any responsibility for such third party’s use of your Information once shared through our API.


Payment and Access

A valid business ACH or credit card and billing information is are required for paid accounts. We will charge you an initial setup fee, a standard monthly or annual fee depending on your account type and payment option. The charges are non-refundable, unless otherwise noted. Should you upgrade or downgrade your account type, your ACH or credit card will be charged the new billing rate immediately. Your credit card will then be charged your new billing rate every 30 days thereafter unless you cancel your account. Billing will be based on the number of users each month based on the monthly anniversary date.

Your Subscription Term will automatically renew monthly or yearly (depending on your subscription), unless you cancel your subscription before the renewal date or tell us that you don’t want to renew at least 10 days before the renewal date.


Modifications to the Fees and Packages

HR Anew reserves the right to change packages, add, or remove features and change fees with 30 days’ notice.



The content within the Service is protected by copyright and other laws in the United States of America and elsewhere.

Your Responsibilities. You understand that all data, text, information, links and other content (collectively, “Content“), whether posted in public or restricted groups, is the sole responsibility of the person from which such Content originated. This means that you, and not HR Anew, are entirely responsible for all Content that you publish, post, upload, distribute, disseminate or otherwise transmit (collectively, “Post“) via the Service. Under no circumstances will HR Anew be liable in any way for any Content, including, but not limited to, for any errors or omissions in any Content, or for any loss or damage of any kind incurred as a result of the use of any Content Posted via the Service. You agree that you must evaluate, and bear all risks associated with, the use of any Content, including any reliance on the accuracy, completeness, or usefulness of such Content. You understand that the technical processing and transmission of the Service, including Content, may involve (a) transmissions over various networks; and (b) changes to conform and adapt to technical requirements of connecting networks or devices. 

Group Administrator Rights and Responsibilities. If you administer a group, you have additional capabilities and responsibilities in regard to the members and Content of a group. The administrator decides whether a group is restricted to certain members or accessible to the public generally, and the Administrator may change the access to the Group at any time. In restricted groups, the Administrator decides who may be a member of the group and can access and change the membership list in his or her sole discretion. In regard to Content, an Administrator shall be responsible for the maintenance and monitoring of the Content in the group, including deleting any group, Content or archived Content at any time and in his or her discretion.

 Sexually Explicit Content. Sexually explicit Content may not be included in this Service.

HR Anew’s Rights. You acknowledge that HR Anew does not pre-screen, control, edit, or endorse Content made available through the Service and has no obligation to monitor the Content Posted via the Service. If HR Anew discovers Content that does not appear to conform to the Terms of Service, HR Anew may investigate and determine in good faith and in its sole discretion whether to remove the Content. HR Anew will have no liability or responsibility for performance or non-performance of such activities.

Content Removal – You understand that HR Anew does not monitor or control the content of information Posted by others, and instead simply provides a service by allowing users to access information that has been made available. It is your responsibility to ensure that your Content meets the requirements for Terms of Service as disclosed herein.


Appropriate Conduct

You agree that you are responsible for your own conduct and communications while using the Service and for any consequences thereof. You agree to use the Service only to send and receive messages and material that are legal, proper, and related to the particular group. By way of example, and not as a limitation, you agree that when using the Service, you will not:

  • defame, abuse, harass, stalk, threaten or otherwise violate the legal rights (such as rights of privacy and publicity) of others;
  • post any inappropriate, defamatory, infringing, obscene, or unlawful Content;
  • post any Content that infringes any patent, trademark, copyright, trade secret or other proprietary right of any party (the “Rights“), unless you are the owner of the Rights or have the permission of the owner to Post such Content;
  • post messages that promote pyramid schemes, chain letters or disruptive commercial messages or advertisements, or anything else prohibited by the Group owner.
  • download any file Posted by another user of a Group that you know, or reasonably should know, that cannot be legally distributed in such manner;
  • impersonate another person or entity, or falsify or delete any author attributions, legal or other proper notices or proprietary designations or labels of the origin or source of software or other material contained in a file that is Posted;
  • restrict or inhibit any other user from using and enjoying the Service;
  • use the Service for any illegal or unauthorized purpose;
  • remove any copyright, trademark or other proprietary rights notices contained in or on the Service;
  • interfere with or disrupt the Service or servers or networks connected to the Service, or disobey any requirements, procedures, policies or regulations of networks connected to the Service;
  • use any robot, spider, site search/retrieval application, or other device to retrieve or index any portion of the Service or collect information about users for any unauthorized purpose;
  • submit Content that falsely expresses or implies that such Content is sponsored or endorsed by HR Anew;
  • create user accounts by automated means or under false or fraudulent pretenses;
  • promote or provide instructional information about illegal activities or promote physical harm or injury against any group or individual; or
  • transmit any viruses, worms, defects, Trojan horses, or any items of a destructive nature.

International users agree to comply with United States of America and their own local rules regarding online conduct and acceptable content, including laws regulating the export of data to your country of residence. While HR Anew prohibits such conduct and Content in connection with the Service, you understand and agree that you nonetheless may be exposed to such conduct and/or Content and that you use the Service at your own risk.


Proprietary Rights

HR Anew ’s Rights – HR Anew  and its affiliates and licensors own and retain all rights in the Service, which contains proprietary and confidential information that is protected by applicable intellectual property and other laws. Except as expressly authorized by HR Anew , you may not copy, modify, publish, transmit, distribute, perform, display or sell any of HR Anew ’s proprietary information. “HR Anew”, the “worksmartanew”, “HR Anew logo” or “worksmartanew logo”, are trademarks of HR Anew.

Your Rights – HR Anew  claims no ownership or control over any Content submitted, posted or displayed by you on or through the Service. You or a third-party licensor, as appropriate, retain all patent, trademark and copyright to any Content you submit, post or display on or through the Service and you are responsible for protecting those rights, as appropriate. By submitting, posting or displaying Content on or through the Service, you grant HR Anew  a worldwide, non-exclusive, royalty-free license to produce, display, adapt, publish and distribute such Content on the Service solely for the purpose of providing the Service to you or your users. This license terminates when such Content is deleted from the Service. HR Anew  reserves the right to syndicate Content submitted, posted, or displayed by you on or through the Service.


General Practices Regarding Use and Storage

You agree that HR Anew  has no responsibility or liability for the deletion or failure to store any Content maintained or Posted by or through the Service. You acknowledge that HR Anew  has set no fixed upper limit on the number of transmissions you may send or receive through the Service or the amount of storage space used; however, we retain the right, at our sole discretion, to create limits at any time with notice.


API Terms

You are granted a limited, non-sublicensable right to access the API, the Services and Data for the purpose of enabling you and your users authorized to access the worksmartanew Services via third party software or website. Any use of the API, including the use of the API through a third-party software or website that accesses the Services, is subject to the terms of this agreement plus the following specific terms:

You agree that you are solely responsible for (and that HR Anew  has no responsibility to you or to any third party for) any services and/or products you provide or use through any third-party software.

You expressly understand and agree that HR Anew  shall not be liable for any direct, indirect, incidental, special, consequential or exemplary damages, including but not limited to, damages for loss of profits, goodwill, use, data or other intangible losses (even if HR Anew  has been advised of the possibility of such damages), resulting from your use of the API or third-party products that access data via the API.

You will not collect any users’ personal information or data in a misleading, illegal, unauthorized or unfair way. Without limiting the generality of the foregoing, you will never collect, store or record passwords used by your users to log-in to the Services. If your users need a separate password to use your software, you will generate a unique password and securely communicate it to your user. You agree that any third-party software shall be provided by you in compliance with all applicable laws and regulations (including without limitation those relating to the protection of privacy and the processing of personal data or traffic data). You will not use the API to create software that sends unsolicited communications (whether commercial or otherwise) to any third party.

HR Anew  reserve the right at any time to modify or discontinue, temporarily or permanently the API (or any part thereof). Where HR Anew  permanently discontinues the API, HR Anew  will continue to provide appropriate levels of support to ensure the continuance of the API which has just been replaced for a period not less than 6 months to be determined by HR Anew , in our sole discretion.

Abuse or excessively frequent requests to the Services via the API may result in the temporary or permanent suspension of your account’s access to the API. HR Anew, in our sole discretion, will determine abuse or excessive usage of the API.

HR Anew  retains the right to the Services, including the API. In no way will you pass off, market or otherwise make representations that the HR Anew  brand, Services or Website is owned or otherwise connected with you. You shall not have any rights to use HR Anew or worksmartanew trademarks or logos.


Disclaimer of Warranties

HR Anew and its affiliates, licensors, partners, suppliers, consultants and agents (“HR Anew“) disclaim any and all responsibility or liability for the accuracy, content, completeness, legality, reliability, or operability or availability of information or Content displayed on the Service. HR Anew disclaim any and all responsibility and liability for your conduct and for the conduct of others affiliated with your account that use the Service. THE SERVICE, AND ALL CONTENT, INFORMATION (INCLUDING, WITHOUT LIMITATION, ANY INFORMATION OR CONTENT OBTAINED OR ACCESSED THROUGH THE SERVICE), PRODUCTS AND SERVICES INCLUDED THEREIN ARE PROVIDED “AS IS,” WITH NO WARRANTIES WHATSOEVER. THE HR ANEW ENTITIES EXPRESSLY DISCLAIM TO THE FULLEST EXTENT PERMITTED BY LAW ALL EXPRESS, IMPLIED, AND STATUTORY WARRANTIES, INCLUDING, WITHOUT LIMITATION, THE WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT OF PROPRIETARY RIGHTS.


Limitation of Liability



Term and Termination

These Terms of Service will apply to your use of the Service. You may terminate your use of the Service immediately at any time, for any reason, by contacting HR Anew. We may terminate your use of the Service immediately at any time, for any reason, and at such time you will have no right to use the Service. Our proprietary rights, disclaimer of warranties, indemnities, limitations of liability and miscellaneous provisions shall survive any such termination.


Miscellaneous Provisions

These Terms of Service will be governed by and construed in accordance with the laws in the State of Maryland, United States of America, without giving effect to its conflict of law provisions or your actual country of residence. If for any reason a court of competent jurisdiction finds any provision or portion of the Terms of Service to be unenforceable, the remainder of the Terms of Service will continue in full force and effect.

You shall not assign these Terms of Service or assign any rights or delegate any obligations hereunder, in whole or in part, whether voluntarily or by operation of law, without our prior written consent. Any such purported assignment or delegation will be null and void and of no force or effect.

Without limiting the foregoing, under no circumstances shall HR Anew be held liable for any delay or failure in performance resulting directly or indirectly from acts of nature, forces, or causes beyond its reasonable control, including, without limitation, Internet failures, computer equipment failures, telecommunication equipment failures, other equipment failures, electrical power failures, strikes, labor disputes, riots, insurrections, civil disturbances, shortages of labor or materials, fires, floods, storms, explosions, acts of God, war, governmental actions, orders of domestic or foreign courts or tribunals, non-performance of third parties, or loss of or fluctuations in heat, light, or air conditioning.
